Introduction

Capital Car Finance Limited are fully authorised and regulated by the Financial Conduct
Authority for consumer credit activity (FCA Registration Number 685925) We are a
credit broker and not a lender, which means we act independently as an intermediary
for a number of dierent finance providers.

We provide an intermediary service whereby we can introduce you to a range of car
finance products from our panel of lenders on a non-advisery basis, please be sure that
you select a product that is suitable and aordable for your needs.

Your Information

Capital Car Finance Limited, our panel of lenders and service providers will use your
personal data to consider your application for car finance, which include but not limited
to full credit searches, which may aect your credit rating.

Credit Searches and Your Application

When you make an application to us, we will carry out the following credit-related
checks:

Soft Search – Eligibility Check:

We may conduct a soft credit search to assess your eligibility for finance. This search
will not aect your credit score and will only be visible to you on your credit file.

Lender Credit Checks – Full Application

If you proceed with a full application, the lender we introduce you to, will carry out a
hard credit check. This will be recorded on your credit file and could aect your credit
score.

Fraud Prevention Checks:

Your information may also be checked against fraud prevention databases to prevent
financial crime.

By submitting an application to us, you agree to these searches being carried out. All
searches will be performed in line with the UK General Data Protection Regulation (UK
GDPR) and other relevant laws

Eligibility

To apply for car finance, you must:

  • Be at least 18 years old
  • Be a UK resident
  • Have a regular income and the legal capacity to enter into a finance agreement
  • Hold a full UK driving license

 

Aordability Assessment

We are committed to responsible credit broking. As a credit broker, we do not lend
money ourselves, but we work with regulated finance providers who assess your
application based on your ability to repay.

Why Aordability Matters

Before any finance is approved, lenders must ensure that the agreement is aordable
for you. This means checking that:

  • You have a regular and sustainable source of income
  • You can meet the monthly payments without undue hardship
  • You are not already over-committed financially

 

What You Need to Do

  • To help lenders make a fair and accurate decision, it is important that you:
  • Provide full and honest details about your income and expenses
  • Disclose any other financial commitments (e.g. loans, rent, credit cards)
  • Inform us if your circumstances change before the agreement is finalised

 

Submitting false or inaccurate information may result in your application being
rejection, or financial diculty later.

What Lenders Check

  • Conduct a credit check with a credit reference agency
  • Ask for proof of income (such as payslips or bank statements)
  • Evaluate your debt-to-income ratio

 

These checks are in place to protect you from entering into an agreement that is not
sustainable.

Our Responsibility

As your broker, we only introduce you to lenders who are authorised and regulated by
the Financial Conduct Authority (FCA). We do not influence a lender’s decision, but we
aim to match you with a suitable finance provider based on the information you give us.

Our Website

Our website is a place for you to view from the comfort of your own home or work
place details of our car finance oers or vehicles being oered for sale by suppliers, or
both where applicable.

Commission

We will receive a commission payment from our lender should you transact business
with us, however, this does not aect the amount that you will pay. We will provide
details of the amount of commission we receive on our “terms of business checklist”
prior to the completion of your transaction.

Intellectual Property Rights

We are the owner or licensee of all trademarks, brand names, business names, logos,
illustrations, images, and other intellectual property rights (“IP Rights”) displayed on our
website and in our electronic communications. These materials are protected by
copyright, trademark, and other intellectual property laws.

You are not permitted to:

  • Copy, reproduce, distribute, or publicly display any of our content
  • Use our materials for commercial purposes
  • Share or publish any part of our content without our prior written consent

 

You may only use our content for your own personal and non-commercial purposes.

We own the licensee of all trade marks, brand names, business names, illustrations,
images and logos and other intellectual property rights (“IP Rights”) which appear on
our website and electronic mail.

You are not permitted to copy, reproduce or make available any of our material in the
public domain in any way and must only be used for your own personal,
non-commercial use.

Law and Jurisdiction

The Agreement, the Service and your use of the Site shall be governed by and
construed in accordance with English law and each party hereby submits to the
exclusive jurisdiction of the English courts.

Complaints Handling

We are committed to customer service, should you have any complaint about the
services we provide, we are committed to resolving complaints in a fair and eective
manner

If you have any complaint about our service, please contact our customer services
department by writing to Capital Car Finance Limited, 10 Alvaston Business Park,

admin@capitalcarfinance.co.uk and we will look into the complaint and attempt to
resolve it.

We endeavor to acknowledge all complaints within 3 working days of receipt and
undertake all reasonable eorts to resolve all complaints in a prompt manner. We will
provide you with a time scale for resolving the dispute and keep you regularly updated
with respect to our progress.

Data Protection

Your data will be processed securely, as per our Privacy Policy, we will collect certain
personal information relating to you (such as your name, address, employment, bank
details, telephone number and e-mail address) (“Personal Information”)

We will not collect or process sensitive personal information relating to you (such as
your political or religious beliefs, racial or ethnic origin, sexual life or health) without
your explicit consent.

Your personal information will be processed by us to check your credit record with any
credit reference agencies and for fraud prevention purposes (which will include the
supply of your personal information to third parties for such purposes) should you
decide to apply for finance;

We may use your personal information to keep you informed by post, telephone, e-mail
or other electronic means about products and services which may have a legitimate
interest to you. By providing us with your personal information, you consent to being
contacted by these methods for these purposes.

For these purposes, we may transfer or disclose personal information to our
professional advisers and to such other parties as we consider necessary or helpful in
the administration of any finance agreement or if required by law or otherwise.

By entering an agreement with us, you consent to the processing and disclosure of the
personal information. You also agree that the purposes for the processing may be
amended to include other uses or disclosures of personal information following
notification to you.

We agree to keep all personal information in a secure environment and will comply with
the Data Protection Act 1998 and the General Data Protection Regulation 2018 [GDPR]
any other applicable data protection legislation currently in force.

have any other comments or complaints in relation to this service agreement please let

Force Majure

Our performance under this services agreement will be excused if we are unable to
perform due to any cause beyond our reasonable control (including but not limited to
any labour dispute, act of God, war, act of terrorism, riot, civil unrest, fire, flood, storm,
or any computer or internet related failure, error or delay (including in your ability to
access the Site).

Governing Law & Jurisdiction

This Agreement, the use of our services, and any use of our website shall be governed
by and interpreted in accordance with the laws of England and Wales.

By using our services, you agree that any disputes arising in connection with this
Agreement will be subject to the exclusive jurisdiction of the courts of England and
Wales.

Statutory / Third Party Rights

Your statutory rights, including any rights you have as a consumer, are not aected by
anything in this Services Agreement. Third party rights under the Contracts (Rights of
Third Parties) Act 1999 are hereby excluded

Limitation of Liability and Indemnity

We do our best to ensure the accuracy and reliability of the information and services
we provide. However:

We do not accept liability for:

  • Loss of income, revenue, business, profits, or contracts
  • Loss of anticipated savings
  • Loss or corruption of data
  • Wasted management or oce time
  • Any indirect or consequential loss or damage

 

This applies regardless of how the loss arises — whether through negligence, breach of
contract, or otherwise — even if the loss was foreseeable

We do not exclude or limit liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any matter where it would be unlawful to do so under UK law

 

Indemnity

You agree to indemnify and hold us harmless from and against any losses, liabilities,
legal costs, or expenses that we reasonably incur as a result of:

  • Your breach of these Terms of Business
  • Your misuse of our services
  • Any false or misleading information you provide to us or to a lender through us
  • Any claim made against us by a third party arising from your actions

 

We will always take reasonable steps to mitigate any loss and to inform you of any
claims where this indemnity may apply.

Jurisdiction and Third-Party Responsibility

Use Outside the United Kingdom

Our website, materials, and services are intended for use within the United Kingdom. We
do not represent that they are appropriate or available for use in other countries.

If you access our site or services from outside the UK, you do so at your own risk. You
are solely responsible for complying with any applicable local laws or regulations.

Third-Party Payments and Deposits

We are a credit broker and do not handle any deposits or payments made to third
parties, including car dealers.

We are not responsible or liable for:

  • The return of any deposit or payment made by you to a car dealer or other third
    party
  • Any issues that arise between you and a third party in connection with a loan,
    vehicle purchase, or related services

 

If you have a dispute or believe a refund is due, you must contact the relevant third
party directly. To the fullest extent permitted by law, we exclude all liability for such
matters.

Key Terms Used Within This Document

“Broker” A company that arranges finance by introducing customers to lenders but
does not lend money itself.

“Lende/Finance Provider” A financial institution or company that provides the actual car
finance (e.g. loan or hire purchase agreement).

“Vehicle” means a vehicle which you wish to purchase using our services;

“Finance Agreement” means a legal contract between you and the lender outlining the
terms of borrowing (repayments, interest, duration, etc.).

“Aordability Assessment” A check by the lender to ensure the borrower can aord the
repayments, typically based on income, expenses, and credit history.

“Commission” means a payment the broker receives from a lender when a customer
enters into a finance agreement arranged by the broker

“FCA (Financial Conduct Authority)” The UK financial regulator that authorises and
supervises companies oering financial products and services.

“Credit Broking” The activity of introducing individuals to lenders in return for a fee or
commission, regulated by the FCA.

“Personal Data” Information that can identify you (e.g. name, contact details, financial
info) and is used according to data protection laws.

“Financial Ombudsman Service” a free and independent service that resolves
complaints between consumers and financial services firms.

“Service or Services” means the intermediary services we provide to assist you when
arranging your car finance and/or to buy a vehicle from our supplier;

“Website” means the capitalcarfinance.co.uk website;

“Supplier” means the third party supplier from whom we will arrange payment for the
vehicle on your behalf;

“We”, “Our” and “Us” means Capital Car Finance Ltd trading as capitalcarfinance.co.uk;

“You” and “Your” means you, our customer
